By your use of this services, you agree to be bound by and comply with these agreement terms. 9file reserves the right to amend these agreement terms from time to time and at any time by posting such amendments on the Website, and your continued use of the the Services following posting of any such amendment constitutes your acceptance of such amendment, regardless of whether you actually have read any such amendment. 1. Proprietary rights

User acknowledges and agrees that each File and its copyrights which show on website 9file.net (hereinafter called Store) are the property of 9file and the contributor of said File, and not the property of User, and are protected by legal and subordinate acts relating to intellectual property including but not limited to copyright laws and other similar laws... Contributors retain all rights, title and interest in the Files and User shall not take any action inconsistent with such title and owners.

2. Private policy

9file respects the confidentiality of private and personal information of all cooperating parties. We may collect personal information when you use our service, your information such as name and address governed by our Privacy Policy

3. Contributor content

3.1. For any files upload to the website from contributor, it has represented and warranted that: (i) contributor have all necessary rights to submit the files and grant the licenses set forth herein; (ii) 9file will not need to obtain licenses from any third party or pay royalties to any third party with respect to the files; (iii) The files does not infringe any third party's rights, including intellectual property rights and privacy rights; and (iv) The files complies with these Terms of Use and all applicable laws.

3.2. By uploading The files, contributor grant 9file a limited, worldwide, non-exclusive, royalty-free license and right to copy, transmit, distribute, publicly perform and display (through all media now known or hereafter created), and make derivative works from the files for the purpose of allowing contributor to edit and display the files using the site and archiving or preserving the files for disputes, legal proceedings, or investigations. The above licenses will continue unless and until you remove the files from the site, in which case the licenses will terminate within a commercially reasonable period of time. Notwithstanding the foregoing, the license for legal archival/preservation purposes will continue indefinitely.

3.3. Contributor may not upload, post, or transmit any, image, text, clipart, or other content that:

• Infringes any third party's copyrights or other intellectual property rights or any right of publicity or privacy;
• Contains any pornographic, defamatory, or otherwise unlawful or immoral content.
• Exploits minors;
• Depicts unlawful or violent acts;
• Depicts animal cruelty or violence towards animals;
• Promotes fraudulent schemes or gives rise to a claim of deceptive advertising or unfair competition; or
• Violates any law, statute, or regulation.

3.4 You may not use any the Store content for any purpose without first obtaining a license to use such the Files. Any use of the website content by you shall be governed by the applicable license agreement separately entered into between you and 9file. Displaying and/or distributing to the public any watermarked or unlicensed the Store (whether incorporated into a derivative work or alone) constitutes copyright infringement.

4. Take down policy

9file respects intellectual property laws and expects all users to follow the same principles. If you consider that any content is infringing your copyright or other intellectual property rights, you may notify 9file in the manner set forth in our DMCA Copyright Infringement Notice Policy.

5. Store integrity and content edition

User agree not attempt to:

5.1. Damage, interfere with or harm our store, or any network or system underlying or connected to our Store, in any way whatsoever;

5.2. Amend or modify any information contained on our Store, unless you are expressly permitted by us to do so; or reverse engineer or decompile our Store or any software comprising or underlying our Store.

5.3. We may edit or change the Store or edit, change or delete any content from the Store at any time.

6. Restriction and termination of use

9file may block, restrict, disable, suspend or terminate your access to all or part of the site and/or 9file content at any time in 9file's discretion, without prior notice or liability to you. Any conduct by you that, in 9file's sole discretion, restricts or inhibits any other person or entity from using or enjoying the Site is strictly prohibited and may result in the termination of your access to the Store without further notice.

7. General provision

9file failure to insist upon or enforce strict performance of any provision of this agreement shall not be construed as a waiver of any provision or right. If any provision of the terms of use can not be fulfilled completely or partially at the territory of a certain country, and the parties are not able to come to an agreement, the parties agree to settle all such matters by judicial process. In this case the court may select the closest statutory provisions, according to which the provision of the terms of use can be fulfilled partially or in full.

8. Governing law

These website terms of use shall be governed by, and must be interpreted in accordance with, the laws of Vietnam. You agree to submit to the non-exclusive jurisdiction of the courts of Vietnam.
